TERMS OF PARTICIPATION

The organiser of this competition and owner of the website www.orangutanfreedom.org is Borneo Orangutan Survival Foundation, Jalan Papandayan No. 10, Bogor 16151, West Java, Indonesia respectively Yayasan Penyelamatan Orangutan Borneo (Yayasan BOS), hereinafter referred to as «BOSF».

 

INTRODUCTION

By entering this competition participants agree that personal data – namely First Name, Family Name, Email address, Phone number and Country of residence – will be transmitted to either the BOSF or one of the following partner organisations – hereinafter referred to as «Partners». In addition, entries agree to be contacted to receive updates about this competition and relevant topics (Please see under «SUBSCRIPTION»).

ELIGIBILITY

The competition is open to all people, who have reached the age of majority in their country respectively jurisdiction of residence at the time of entry to the competition. However, to enter the competition participants must be over 18 years old.

All supervisors, employees and interns of BOSF and its partners as well as the relatives of the aforementioned persons, are excluded from participating.

By submitting the entry to the competition participants certify that their participation hereunder is not illegal or in against of any laws and regulations, and that the laws of their ruling jurisdiction of residence at the time of entry do not prohibit or restrict the receipt of any prize hereunder.

BOSF reserve the right to reject any entry if the laws of an applicable jurisdiction, including to the participants jurisdiction of residence at the time of entry, would prohibit or limit BOSF and its partners from proceeding with the competition.

 

DURATION

The competition begins at 8 a.m. UTC/GMT plus 7 hours on October 1, 2017 and ends at 11:59 p.m. UTC/GMT plus 7 hours on October 31, 2017. Receipts before or after the duration of this competition will not be eligible.

 

ENTERING

Participants confirm their agreement and acceptance of the Terms of Participation by clicking the relevant checkbox on the entry form. Their approval certify the information supplied here in to be true and correct. The following information is required for entering the competition: First Name, Family Name, Email address and Country of residence and will be collected, used and stored in accordance with the Privacy Policy applicable hereunder.

By clicking the age checkbox, entries certify that they are over 18 years of age and reached the age of majority in their country respectively jurisdiction of residence at the time of entry the competition and agree to be bound by these terms and conditions of use. On a separate checkbox they certify that they agree to the Privacy Policy applicable hereunder.

BOSF reserves the right to reject any entry that does not comply with the Terms of Participations or if the registration is inaccurate or incorrect.

 

PRIZE

The prize is to win a trip to Indonesia to experience a release of an orangutan. The release will be witnessed from a boat in order to remove all the difficulties of quarantine regulations. The prize is for two people and includes the following:

→ 1 x 2 Round Trip tickets from the winners City of residence to Jakarta;

→ 1 x 2 Outward flight tickets from Jakarta to Balikpapan;

→ 1 x 2 Outward flight tickets from Balikpapan to Palangka Raya;

→ 1 x 2 Outward flight from Palangka Raya to Jakarta;

→  all related costs of the release of an orangutan on Salat Island; and

→  all accommodation costs, transportation cost and expenses for trip-related meals during the journey.

The designated winner and his/her companion are responsible for paying any other expenses any other out-of-pocket expenses.

The prize may not be transferred and must be accepted as awarded. The winner and his/her companion may not request cash or a substitute prize. However, BOSF reserve the right to substitute a prize with another prize of equal or smaller value if the prize cannot be realised for any reason, as determined hereunder.

It is the winner’s responsibility to arrange their own travel insurance. The winner must also make sure that he or she is up-to-date on all recommended vaccinations before the trip at his own costs.  

 

SPONSORING

Flights and accommodations as part of the prize under the aforesaid competition may be sponsored by third parties. However, this competition is in not sponsored by, endorsed by, administered or associated with Facebook, Instagram, Twitter and YouTube.

 

DETERMINATION OF THE WINNER

After closing of the competition UTC/GMT plus 7 hours on October 31, 2017 BOSF will pick the winner randomly within 5 (five) days of aforesaid closing date. The designated winner will be informed by email. The winner agrees, that he/she will be revealed on the competition website, on a official winner email as well as on all social media channels from BOSF and its partners – by stating his/her First Name, Family Name and Country of Residence. The winner agrees and approves that photos will be made of him/her and his/her companion during the trip, which may be used on the competition website, for mailings hereunder as well as on all social media channels from BOSF and its partners.

The decision under this competition is final. Participants are not allowed to protest or judge against this decision by BOSF and its partners.

 

WINNER DEMANDS

The designated winner may be required to complete and return a confirmation of eligibility, including proof of age and liability release within 7 (seven) working days. If a winner fails to return this information on time, an alternative winner may be selected in his/her place. If the winner does not respond in any way, the prize shall be forfeited, either.

The designated winner may be required to show proof of being the authorized email account holder. In the event of a dispute as to the owner entry, the authorized account holder of the email address used to enter will be considered to be the owner.

 

SUBSCRIPTION

By entering this competition the email holder will automatically become a mailing subscriber either from of BOSF or one of its partners depending in the area of residence. The recipients may cancel and unsubscribe at any time. Therefore, participants agree that their data, namely – First Name, Family Name, Email address, Phone number and Country of residence – will be handed over to either the BOSF or one of the following partner organisations and that BOSF and its partners will use the data to keep entries up to date with this competition, to provide them with information – for example adoption updates or magazines – or to ask for financial and non-financial support

GENERAL TERMS

BOSF reserve the right to cancel or terminate the competition due to unforeseen circumstances without any prior notice. This shall especially apply if the competition is not able to run according to plan, e.g. in the event of technical or legal reasons, which affect the running of this competition.

BOSF and its partners reserves the right to disqualify and seek damages from any individuals, who falsify the operation of this competition, violate these terms and conditions hereunder or acts in a disruptive manner.

By entering, participants agree to release and hold harmless BOSF and its partners and each of their respective officers, directors, employees from and against any claim or cause of action arising out of participation in the competition or receipt or use of any prize hereunder. Furthermore, participants waive the right to claim any fees and damages whatsoever, including punitive, direct and indirect damages.

 

DISPUTES

Entries agree that any and all disputes, claims and causes of action arising out of, or connected with, the aforesaid competition or prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Jakarta, Indonesia.

All issues concerning the validity, interpretation and legal enforceability of these terms, participant’s rights and obligations, or the rights and obligations of BOSF in connection with this competition, shall be governed by, and construed in accordance with, the laws of Indonesia.
